A Muse Amidst the War: The Life of Estelle Ishigo Essay
Estelle Ishigo is a Caucasian woman who lived during the World War II. Unlike her fellow women who have also lived during her time, Ishigo showed an exceptional amount of bravery and determination to outwit the challenges and tests of war. Instead of abandoning her Japanese American husband Arthur, Ishigo opted to accompany him together with other Japanese Americans. A painter and an illustrator, Ishigo sketched what she has seen and experienced during her stay in the internment camps in Pomona, California and Heart Mountain in Wyoming. These talents of Ishigo were utilized to serve those in need. In Heart Mountain Camp, Ishigo was allowed by the War Relocation Authority to illustrate images of the people during war. Most of Ishigoââ¬â¢s works were used to depict not only the actual events and people affected by the war, but the emotions they carry as well. Ishigo was successful in describing through her works the scenario in the internment camps. Most of her subjects were the Japanese Americansââ¬âhow they managed to live and survive the war. Interestingly, the Japanese Americans were still full of courage, hope, and dignity to build a home under such crucial circumstances. These emotions were very much evident in Ishigoââ¬â¢s ilustrations. The life in the internment camps was actually as hard as living as a soldier of war. The War Relocation Authority had described the internment camps as a barracks covered by tar paper and no cooking or plumbing facilities. The Heart Mountain Relocation, being surrounded by barbed wire, was inadequate to provide the interns budget, toilets, and beds. Reflection of Daily Nutrition Intake Essay
Hypothesis: My daily caloric intake is anticipated to be higher than the recommended allowance of carbohydrates, lipids and sodium; however, it is expected to be lower than the recommended allowance for proteins, minerals, and vitamins. Research: In the United States, people use almost their entire food budget on processed foods which often have been treated with chemicals after being harvested or butchered. These chemicals are additives and preservatives which are substances intended to change the food before it is purchased by customers. Additives can be flavorings that enhance the foodââ¬â¢s taste, dyes that alter the color, and dietary additives, such as vitamins, minerals, fatty acids and other supplements. Preservatives are used to extend a products shelf life by preventing bacterial or fungal growth, oxidation (which can lead to the discoloration or rancidity), or inhibiting the natural ripening of fruits and vegetables. Packaging is considered an ââ¬Å"Indirect Food Additiveâ⬠because it can add substances to the food it protects. A common preservative in the food that I eat is called propionic acid, which prevents mold in bread. Also, most processed foods rely on additives to restore the flavor that is lost in processing or create new flavors altogether. For example McDonaldââ¬â¢s chicken products like Chicken McNuggetsà ® add ââ¬Å"chicken flavorâ⬠. A food additive is considered fit for human consumption after the Food and Drug Administration (FDA) approves it. However, this decision can prove to be poor because when certain chemicals are added to processed food products, some of these food and color additives provoke an allergic reaction or other critical health problems. For example, monosodium glutamate (MSG) causes headaches, nausea, weakness, difficulty breathing, drowsiness, rapid heartbeat, and chest pain. This can be avoided because it is required for all of the ingredients to be listed on the food label. Unfortunately, additives and preservatives are often unclear as to what they include. Saturated fat is found in foods from animals and certain types of plants. Foods from animals include beef, lamb, pork, lard, poultry fat, and other dairy products made from milk. Foods from plants that contain saturated fat inclu de coconut, tropical oils, and cocoa butter. Two types of unsaturated fat are polyunsaturated and monounsaturated fats. They are found mostly in fish, nuts, seeds and oils from assorted plants. Trans-fatty acids are found in small amounts in various animal products such as beef, pork, lamb and the butterfat in butter and milk. Both polyunsaturated and monounsaturated fats are considered to be healthy because they may help lower oneââ¬â¢s blood cholesterol level when replacing saturated and trans fats. Unsaturated fatty acids are found in two different types: ââ¬Å"cisâ⬠and ââ¬Å"trans.â⬠These terms refer to the hydrogen atoms physical positioning around the carbon chain. The cis form is more common than the trans form. In some studies hydrogenated fats, or trans fats, mostly raised the total LDL cholesterol level and lower the HDL cholesterol levels. This could result in the heightened risk of heart disease. Essential Vitamins and Minerals are often called micronutrients because only a small portion is needed to live a healthy lifestyle. Without these micronutrients one is almost guaranteed to become infected with a disease like scurvy, blindness or rickets. Although they are both considered micronutrients, vitamins and minerals differ in basic ways. Vitamins are organic and can be broken down by heat, air, or acid. Minerals on the other hand are inorganic and hold on to their chemical structure. Essential Vitamins include Fat-Soluble and Water-Soluble Vitamins. The water-soluble vitamins are B and C and the fat-Soluble Vitamins are A, D, E, and K. The fat-soluble vitamins include A, D, E, and K. Firstly, Vitamin A is vital for good vision, prevents night blindness, keeps mucous membranes healthy and is necessary for healthy skin and hair growth. Next, Vitamin D is found in foods obtained from the sun. It helps bones use the mineral calcium to build strong bones and it prevents rickets. Also, Vitamin E helps breakdown polyunsaturated fats. It is an antioxidant that protects blood cell membranes from too much oxygen. Finally the fat-soluble Vitamin K is essential for the clotting of blood. It can be found in foods or produced in bacteria in the small intestines. The water-soluble vitamins are B and C. C is the most famous vitamin, and is also referred to as ascorbic acid. It helps form collagen, grow and repair body tissue and blood vessels, and prevent scurvy. However, too much Vitamin C can lead to the creation of Kidney stones and the breakdown of red blood cells. Vitamin B is complex and has several different types such as B1 (Thiamine), B2 (Riboflavin), Naicin, B6, B12, and Folacin. Amino Acids are organic compounds. They are the monomers of proteins and consist of both an amino group and a carboxyl group. The human body is unable to synthesize certain amino acids called ââ¬Å"essential amino acids,â⬠ââ¬Å"the human body can synthesize all of the amino acids necessary to build proteins except for the ten called the ââ¬Å"essential amino acids.â⬠â⬠(Nave 1) For example, some of the ââ¬Å"essential amino acids are Leucine(leu) and Phenylalanine. Conclusion: My hypothesis was correct because as I cataloged my daily nutritional intake I found that the recommended allowance of carbohydrates, lipids and sodium is lower than what I eat and the recommended allowance for proteins, minerals, and vitamins is higher than what I eat. I am supposed to take in approximately 2000 calories a day and, on average, I only eat 900 calories a day. As I reflect on my daily nutritional intake I realize that in order to have a completely healthy lifestyle I must have more essential vitamins and minerals as well as proteins in my diet. Abortion in the United States Essay ? Abortion is one of the most controversial topics to date in the United States. Because of the complexity and issues involved, there are those individuals who are for abortion, and those who are against. There is neutrality that extends between the two, with those who are one the fence depending on circumstantial situations. In this paper our group of four peers debate the topic, and base a conclusion on weather women in the United States should have the right to abortion, based on the arguments themselves. Today, the reference of for and against, is better known as pro-choice and pro-life. Pro choice (abortions) refer to the political and ethical view that a woman should have complete right over her fertility, and that she should have the freedom to decide whether she wants to continue or terminate her pregnancy (Bose, 2012). According to pro-life advocates, women who demand complete control of their body should also shoulder the responsibility of preventing unwanted pregnancy, and that the result of an unplanned pregnancy, rape or incest, aborting the embryo is equivalent to punishing the unborn child (Bose, 2012). The position that Valora has in this debate, is that it is the womanââ¬â¢s choice to decide whether or not to have an abortion, but also to understand that it is their responsibility to protect against unwanted pregnancies by using every available means of contraceptive, not including using abortion as if it were a contraceptive, as some pro-life advocates would claim. When evaluating risk, one should take in account of womenââ¬â¢s feelings after an abortion. Feelings of depression and anxiety is something woman feel prior, and of course afterwards. Women sometimes choose abortions because of medical issues with the babies, or horrifying circumstances leading to the unwanted pregnancy. Henry P. David, PhD stated after conclusive research ââ¬Å"severe psychological reactions after an abortion are infrequentâ⬠. The best indicator of your mental feelings after an abortion is to realize your feelings and mental health prior to the abortion. (ProChoice.org). Usual feelings aft er an abortion is relief, loss, sadness, and grief. It is okay to grieve and you should give yourself time to grieve. Women who have had abortion may have feelings of sadness because they had to make the decision on their own without help from family and friends. Some woman may live in a home life where they are made to feel worthless because of the decision they will make. Some believe women who decide to have abortions will come down with ââ¬Å"Post-Abortion Stress Syndromeâ⬠, which is psychological trauma or deep depression, and the American Psychological Association has found no scientific evidence that abortion leads to this type of trauma. Furthermore, experts stated after a study with the National Cancer Institute studied abortions and breast cancer, trying to see if there is any link between an abortion and breast cancer. In the end they settled that there was no link between the chances of breast cancer if you had received an abortion. In the United States, technology has made abortion safer in the last few years. Abortions are performed with in the first 9 weeks of pregnancy. Early termination the better is for the woman, less complications. Most woman receiving their abortion within the first 9 weeks report no complications afterwards. Less than 0.5% of women have serious complication that may bring them back to be seen or hospitalized. Complication rates to rise if the abortion is decided with the pregnancy weeks of 13 and 24. The position of Tracy in this paper is that abortion should be the right of the woman. I do not believe the government or any religious authority should make this type of decision for any woman. Deciding to have an abortion is an important decision in itself and having others dictate you can or cannot choose makes the situation even more confusing. As with most any conflicts, there are usually laws which govern the actions those directly involved, and with abortion comes some of the most well-known pieces of legislature in history. Today in the United States abortion is legal in every state due to the decision of Roe v. Wade. In this case the appellant (Roe) sued the state of Teas on the basis that personal privacy was violated unconstitutionally when the state proscribes that it is unlawful to abort a fetus, other than to save the life of a mother, advised by a licensed medical physician. The ruling decided on January 22, 1973 by the United States Supreme Court was a major milestone in the still controversial topic of abortion. According to the court ââ¬Å"the abortion statutes void as vague and over-broadly infringing those plaintiffââ¬â¢s Ninth and Fourteenth Amendment rightâ⬠(Roe v. Wade). On the same day of the Roe decision, another case in the state3 of Georgia was also decided on, in the case of Doe v Bolton we the state in question also was found to be in violation of the appellants constitutional rights. The Ninth Amendment: The enumeration in the constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. The Fourteenth Amendment: Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or poverty, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws (Legal Information Institute). The position that Timothy has on this subject, is that a womanââ¬â¢s right to abortion should be that of her own decision based on the legislationââ¬â¢s that have been passed. A woman should be able to do with her own body as she chooses, not including using abortion as a method of birth-control. Abortion is not all together without some medical complications. The side effects of abortion are sometimes critical. Some of them involve spotting and bleeding. You could be bleeding for past 30 to 60 days, bleeding which could be very dangerous if care was not sought from a physician. Another side affect is headaches and dizziness, fever and chills, nausea and vomiting, cramping, and diarrhea. Sometimes abortion can even lead rare instances of death. During the surgery the doctors may leave some parts of the fetus inside the body. That is what may cause the affections that may cause damage to the body and or death. The symptoms are high fever, diarrhea, cramping, foul smelling in your discharge and more. Your cervix may get injured and damaged by the surgical tools that are being used during the abortion procedure which will lead to not being able to conceive again. Women who have gone through abortion are at a greater risk of ovarian and cervical cancer. Abortion is a very short p rocedure but it impacts your life forever, and the after affects of abortion varies from physical and psychological effects. Women may develop an eating disorders, or drugs on alcohol abuse, or they may have flash backs about the procedures themselves. Abortions may cause problems in relationships, and it may affect the womanââ¬â¢s sex life which leads to sexual dysfunction. The position that Veronica has on the subject of abortion is that she does not agree with the procedure, and the word abortion can be discussed in two different ways. Therapeutic abortion is one, where the abortion is unplanned due to medical problems with the patientââ¬â¢s health also unknown as miscarriage. Another way is elective abortion when it is planned. In many states planned abortions are illegal and have resulted in up to 70,000 deaths across the world every year. Many arguments support the issue on abortion. One reason why I am against abortion is that you are killing an innocent child that has nothing to do with the mistakes that one makes by having unprotected sex. You should not kill an unborn child because you are ashamed and afraid of what people might say about you. Another reason why she is against abortion is itââ¬â¢s against her religion. ââ¬Å"If I make a mistake and got pregnant, then I would have to step up to the plate and take care and raise my child. It is against my religion to have abortions, because children are a gift from Godâ⬠. In conclusion of this paper, there are two sides to this debate on whether women should have the right to have abortions in the United States. The research shows that the peer group has more emphases on the pro-choice side of the debate, because the laws of abortion are designed to protect the welfare of the mother and in some cases the fetus, if there is evidence of potential danger, and the fetus may be born with severe disorders, or mother having serious complications that could threaten the motherââ¬â¢s life. In the past, abortions were not as safe as they are today due to advanced technologies, making abortion safer than theyââ¬â¢ve ever been before. Abortion is sometimes the best course because of medical issues, and sometimes due to other horrifying circumstances in which some women may become pregnant, such as rape, incest, and or other circumstances that may be legitimately valid reasons, and may lessen the quality of life for the child or mother. In 1973 it was decided by the highest court in the United States (The Supreme Court), that prior statutes infringed on the rights of women in such cases as Doe v Bolton, and Roe v Wade, making abortion legal, and the right of women to choose. Opposing arguments have raised health related issues of having abortions such as ââ¬Å"Post-Abortion Syndromeâ⬠, breast cancer, and depression, but upon studies conducted by the National Cancer Institute, and The American Psychological Association, there has been no scientific evidence to prove the accusations. Abortion will probably remain one of the most controversial topics known to man, but the pros, and the laws which protect, are essential in preserving individual rights of freedom in the United States. The three most famous neorealist directors are Roberto Rossellini, Vittorio De Sica and Luchina Visconti. One critic notes that the neorealist movement is widely regarded to have started with Rosselliniââ¬â¢s gritty and unsentimental about a resistance prieced Rome, Open City in 1945. This kind of film became famous for ââ¬Å"a sparse style of shooting on actual locations, with mostly nonprofessional players, and emphasizing themes of basic human problems and issues.â⬠(Hamilton, 2006, p. 61) Children often feature, as in the film Shoeshine by Vittorio De Sica, which tells the at times harrowing tale of two boys who dream of owning a horse and fall into the hands of some corrupt policemen. The realistic portrayal of the sufferings of the boys in prison, raises issues abou t the kind of society that Italy can and should be setting up now that the war is over. Another critic notes: ââ¬Å"neorealism became the repository of partisan hopes for social justice in the postwar Italian state.â⬠(Marcus, 1986, p. xiv). The films of Rossellini deal with the devastation that has been caused by the war in Europe, and he made a trilogy which explored how the poorer people in Italy and German came to terms with the turmoil. These films do not have a traditional narrative line, but show episodes which between them build up a picture of life in those difficult days. Small visual items can have symbolic meaning far beyond the immediate context of the film, and the skill of Rossellini and others was to use the camera to illuminate deeper issues through images. The camera work is the opposite of Hollywoodââ¬â¢s slick and artificial interiors, preferring the rather stark and ugly landscape of the war-torn countryside, and the dirty streets where people have to s cratch a living any way they can. The films were popular at the time, despite their lack of a clear plot. People learned to look at the films in a new way, as a window on life itself: ââ¬Å"Even the Italian neorealist directors, who stress everyday reality in their films and deny the validity of invented stories, argue that their particular brand of everyday reality is not boring because of its complex echoes and implicationsâ⬠(Boggs and Petrie, 2000, p. 37) Another feature of the neorealist directorsââ¬â¢ work was that it had universal appeal, despite being very firmly tied to local scenery. Rosselliniââ¬â¢s vision of a bombed and derelict Berlin in Germany, Year Zero, for example, juxtaposes a blond child and the colossal ruins of the city, with tragic consequences. The overwhelming message of the film is the destruction and futility of war. Heaps of rubble obliterate the civilization that was there before, leaving the boy adrift and hopeless, with no past and no futu re. The second film in Rosselliniââ¬â¢s trilogy, Paisan, depicts the American soldiersââ¬â¢ encounter with demoralized Italian rural people in different regions, distilling the experiences of the war years in to the faces and conversations of unsophisticated farm workers. In 1934 Lord Wright said in Lochgelly Iron and Coal Co v McMullan [1934], ââ¬ËIn strict legal analysis, negligence means more than heedless or careless conduct, whether in omission or commission: it properly connotes the complex concept of duty, breach and damage thereby suffered by the person to whom the duty was owing.ââ¬â¢ In Murphy v Brentwood District Council [1990], the House of Lords held that the council was not liable on the basis that the council could not owe a greater duty of care to the claimant than the builder. In doing so the court also overruled Anns and the two-part test, preferring instead a new three-part test suggested by Lords Keith, Oliver and Bridge in Caparo v Dickman [1990]. In order to impose liability on the employers, Betty has to established foresight, proximity and fairness and it is the current test. In Caparo industries v Dickman [1990], the shareholders in a company bought more shares and then made a successful takeover bid for the company after studying the audited accounts prepared by the defendants. They later regretted the move and sued the auditors claiming that they had relied on accounts, which had shown a sizeable surplus rather than the deficit that was in fact the case. The House of Lords held that the auditors owed no duty of care since company accounts are not prepared for the purposes of people taking over a company and cannot then be relied on by them for such purposes. Harry was an employee but the asbestos did not affect him. His wife suffered mesothelioma, so the current test has to show three things if there is to be a duty of care: 1) It was reasonably foreseeable that a person in the claimantââ¬â¢s position would be injured. Here for Betty Bloke, the risk was reasonably foreseeable as an employee but as a third party it is difficult to show. 2) There was sufficient proximity between the parties. Employers owed some duties to employees. 3) It is fair, just and reasonable to impose liability. After the Caparo test Betty may be satisfy three criteria. Then it will be a vital question that Employers breach any duty or not. The second problem is who has right to sue. Harry was an employee but he is not suffered any disease though it was obvious. If Harry sues on behalf of Betty then it will justify imposing liability to the employers. Here it will be discussed considering the relevant case laws. Bolton v. Stone test may be applicable to prove breach of duty. According to this test employers are not liable. As a general rule English law does not impose a duty, reasoning that the fault of X and not that of D. But exceptionally a duty may arise. Employers are vicariously liable for the negligent acts or omissions. Employers are also liable under the common law principle represented in the Latin phrase, qui facit per alium facit per se. So according to Home Office v Dorset Yacht [1970], and Lewis case it will be consider here. In Hotson v East Berkshire AHA [1987], a young boy suffered a fractured hip when he fell out of a tree. The hospital negligently failed to make a correct early diagnosis so that he later developed avuncular necrosis, a deformity of the even without the failure to diagnosis promptly. On this basis the trial judge, and later the Court of Appeal, awarded him 25 per cent of the damages they would consider appropriate for the loss of a chance of recovery. The trial judge commented that the hospital had translated the probability of the disability developing into a certainty by negligence in their failure to diagnosis. However, the House of Lords allowed the Health Authorityââ¬â¢s appeal and would not consider the slim chance of recovery an issue of causation. In Blythe v Birmingham Waterworks [1856], the basic Rule is that the defendant must conform to the standard of care expected of a reasonable person. ââ¬ËNegligence is the omission to do something which a reasonable man guided upon those considerations which ordinary regulate the conduct of human affairs, would do, or doing something which a reasonable and prudent man would not do. Betty could get compensation by applying McGhee. In McGhee v National Coal Board [1973], here the claimant worked in a brick kiln where he was exposed to brick dust, a possible cause of the dermatitis that he in fact contracted. The Board was not liable for exposure during working hours. They were held liable for materially increasing the risk of the claimant contracting the disease because of their failure to provide washing facilities, even though it could not be shown that he could have avoided the disease if there had been facilities the reasoning of the court was that, since the employer was clearly negligent in failing to provide basic health and safety the burden should shift on to them to disproved the causal link. This type of test is clearly more advantageous to a claimant than the basic ââ¬Ëbut forââ¬â¢ test applied so rigidly in Hotson v East Berkshire AHA [1987]. To identify the employerââ¬â¢s liability suffered mesothelioma after exposure to asbestos dust of Betty Fairchild v Glenhaven Funeral Services Ltd and others is the most significant test. In the case of Fairchild v Glenhaven Funeral Services Ltd and others [2001], the claimants suffered mesothelioma after exposure to asbestos dust over many years working for a number of different employees. The medical evidence identified hat the inhaling of asbestos fibres was the cause of the disease. Nevertheless, it was impossible to identify in which particular employment the disease was actually contracted. The Court of Appeal accepted that medical evidence could not identify a single cause of the disease, which might be caused by contact with even single asbestos fibre, or may involve cumulative exposure to fibres. The Court of Appeal in fact rejected the claims. The HLs, accepted the expert evidence that it is scientifically uncertain whether inhaling a single fibre or inhalation of many fibres causes the disease. However, the HLs held that, because it is evident that the greater the exposure has a duty to take reasonable care to prevent employees from inhaling the dust. Besides this the House felt that any other cause of developing the diseases could be ignored in the case. On the basis that the claimants suffered the very injuries that the defendants supposed to guard against, the HLs were prepare to impose liability on all employers. The House chose to apply the ââ¬Ëmaterial riskââ¬â¢ test from McGhee. In doing so the house held that because all of the defendants had contributed to a risk of mesothelioma, then no distinction should be drown between the makings of a material risk of causing the disease and course of action that would materially increase the risk of the diseases. Because the Employers should only be liable for proportion of the damages then each employer should be liable to compensate its employee un full, even though the employee may have inhaled more asbestos fibres while working for another employee. As a result the Court held that the precise employer responsible could not be identified and so the claim should be rejected. It is impossible to say with certainty how the disease begins, but it is possible to identify that prolonged exposure worsens the risk. It seems then that The Court of Appeal applied Wilsher v Essex AHA [1986] inappropriately where McGhee v National Coal Board might have been more fairly applied in the circumstance. The House of Lords has in any case subsequently reversed The Court of Appeal decision. In Holtby v Brigham Cowan (Hull) Ltd [2003], here the claimant had been exposed to asbestos dust for more then 40 years while working for different employers. When he contracted asbestosis he sued the defendants, for whom he had only worked for half of that time. The trial judge reduced damages by 25 per cent. The claimant appealed and tried to argue for application of the principle in McGhee, that once having established a material contribution by the defendants he was entitled to full damages. The Court of Appeal rejected his argument and upheld the trial judgeââ¬â¢s award, even though 50 per cent deduction would have seemed more accurate. McGhee was distinguished. A majority of the House of Lords in Gregg v Scott [2005], reaffirmed the general approaches in Hotsonââ¬â¢s case should be followed and declined to depart radically from its principles. In Wilsher v Essex AHA [1986] the House of Lords identified that the excess oxygen was just one of six possible causes of the condition and therefore it could not be said to fall squarely within the risk created by the defendants. The court would not impose liability on the defendant in this circumstance although this seems very unfair. The main purpose of the rules of causation is to exclude those thinks that are not the cause of the damage. If the same damage would have been suffered even if the there had been no breach of duty of care, then he claimant loses. The breach of duty of duty may initiate a whole chain of further events-but some of these will be treated as to ââ¬Ëremoteââ¬â¢ from the original negligence for it to be appropriate to hold the defendant answerable for those distant outcomes. The test of remoteness of damage in the tort of negligence was said to be whether the damage the direct consequence of the breach of duty. The defendant was not liable, if it was merely indirect, which ââ¬Ëbroke the chain of causationââ¬â¢. This test was particularly associated with the decision of the Court of Appeal in Re Polemis [1921]. In The Wagon Mound [1961], The Privy Council held that defendant would be liable only if it was the foreseeable consequence. From the above discussion, a number of points can be made, which will be consider that Betty get compensation or not. â⬠¢ The judges in the House of Lords in Fairchild accepted that the sufferers of mesothelioma, while inevitably deserving of compensation, are unable to satisfy the normal tests for causation because they will invariably be unable to point to a single party who is responsible. â⬠¢ The Court was prepared to accept the possibility of a claim for three connected reasons: Claimants in such actions were unable to satisfy for causation only because of the current state of medical knowledge on the disease, although there could be no doubt that exposure to the asbestos fibres in whatever volume was at the root of the disease. Defendant has to prove that their negligence could not be the actual cause rather then the claimants prove the precise cause. The employerââ¬â¢s duty of care would be meaningless, as they could almost never be made liable. â⬠¢ The majority of the judges were therefore prepared to accept an exceptional principle of McGhee. â⬠¢ The Court was not prepared to extend principle of McGhee to factual circumstance such as those in Wilsher. â⬠¢ The House of Lords appear to have engaged in a policy decision in order to ensure that there is compensation for asbestos related diseases contracted in the course of employment. So there is a limited chance to get compensation according to applying Fairchild and McGhee. Then three employers will be liable and bear compensation fully. But if Court apply Hotson v East Berkshire AHA Betty or Harry does not get compensation. The debate of nature versus nurture Debate on nature versus nurture focuses on individuals innate attributes also known as innatism as compared to personal experiences, also called empiricism, in influencing or determining personal differences in behavior and physical traits. Nature relies on the biological/genetical composition of individuals in determining behavioral as well as physical attributes on an individual. Genes originate from the parents and are unique between persons. The nurture orientation in shaping an individual focuses on the influence on a contextual environment of an individual in determining the attributes and character to be developed (Cummings, 2008). Introduction In context of homosexuality, the nature concept determines the possibility that a certain genetical combination during fusion of sex chromosomes naturally predisposes an individual to homosexuality. The implication is that a homosexual is born so and as such, any form of discrimination directed towards the homosexual is an issue of civil right since one did not choose to be so. On the other hand, the nurture concept displays homosexuality as a behavior instilled by the environment within which a person grows or interacts with. As such the parental, peer and other social environment, may contribute to homosexual attributes exhibited by an individual (Bozett, 1989). It can be easily understood that the physical characteristics are inherent from the parents, but its practically hard to comprehend that the behavior of an individual depends fully on the behavior of the parents such that it is genetically inherited. Studies indicate that a nature-given talent, ability or attribute can be e nhanced or inhibited by the environment in which a person grows in. As such both aspects of nature and nurture are in play in shaping an individual. Discussion Natures influence on homosexuality According to Shaffer (2008), siblings do inherit various physical characteristics directly from the biological parents. The traits may include eye color, height as well as predisposition ailments that are physical. Drawing from this later statement, human beings can as well inherit certain mental traits and attributes from biological parents. Mental characteristics may include susceptibility to attacks by certain mental disorders. Homosexuality, a personality attribute, is a mental state within a person that urges the person to have intimate relationship with individuals of the same sex/gender. As such, the mind of a homosexual houses an acquired composition or an orientation. The orientation to homosexuality may be coined in the autonomy or the divergent thinking characteristics all of which can be inherited from the parents. Indeed what society inculcates to people deprives people of their possible autonomy and divergence in thinking that would have developed them to completely dif ferent people. According to Nardi Schneider (1998), there is a biological relationship between personality of resultant sibling and the parents. For example, extroversion, which is the social and outgoing character in a person and neuroticism, which is the moody and over sensitivity behavior in a person. Furthermore, researches indicate that schizophrenia which is a psychological disorder characterized by confusion, delusions and scattered thoughts is genetically inherited. In fact, if a family member has the disorder, there is a possibility of there being others in the lineage. In addition, major depressions and alcoholism, which are psychological disorders has also been found to be hereditary whether the social environment is changed or not, (Soble, 2002). There is therefore a possibility of a gene that is independent of the larger society and defies the society to manifest itself in homosexuality. It is however important to note that from the Minnesota registry and Australian Registry twin studies, only thirty eight and thirty percent gay and lesbians respectively resulted from their twin brother/ sister being gay or lesbian (Brewer, 1999). From the studies, it can be deduced that the correlation is not perfect since it is not a hundred percent. As such, it may be suggested that g enes influence indirectly, though on average do not account for homosexuality sexual orientation. The aforementioned discussion leads to a conclusion that though the genetical passing over of human attributes contribute to homosexual habits; still there is/are other aspects in play to homosexuality. As such, while dwarfs, supermen and superwomen can blame their physical characteristic wholly on genetical combination, homosexuals cannot. The indication is that homosexuality is partly contributed by a decision and choice for it. Choice and decision comes to play with environment exposure which depicts the larger perspective of nurture. Nurtures influence on homosexuality The environment within which an individual grows and develops in has an influence on the resulting personality of such individuals (Mathew et al, 2003). Indeed, the development of language to be spoken is learnt from the interaction with the environment of an individual. The environment will include the physical as well as the social aspects of an individual. For example, a research conducted by Robinson in fiscal 1982 on the influence of nurture to homosexuality had the following details. Methodology The participants included two hundred and eighty five gay and forty seven lesbians from DIGNITY association, a homosexual association in USA. Each participant received a questionnaire via mail, responded to it and mailed it back to the researchers. The questionnaire assessed the couple status, past family life, demographic information as well as parental relationship with the individual respondents. The respondents were from diverse faith including Catholic, Protestant and atheism whose level of education was between high school and doctorate levels. Findings and discussion Seventy six percent of all respondents expressed their early life as full of care and love from their parents compared to twenty four percent who felt that their early life was unbearable. In addition, more than eighty percent expressed their parents approval of their behavior as they grew up as well as the current behavior as homosexuals. The findings reveal individuals whose family setups availed the care that children require while growing up. Socially, their parents supported them by offering approval of their conduct as they grew up. The implication is that homosexuality does not result from a neglected and unsociably individuals but from people who fit in the societal context. Furthermore, the participants expressed their parents satisfaction on the life and behavior of homosexuality that they had adopted. This further implies that homosexualitys acceptability was evident. The homosexuals who participated in this research indicate that the urge to homosexuality was not as a res ult of a mental force beyond their control but as a choice that they had made. Their level of education indicates that they would have changed their sexual orientation if they wanted but their energy was directed to making their relationship with homosexual partners stronger (Jones Yarhouse, 2000).). The deduction is that since homosexuality is a mental state in an individual and not a physical attribute, learned individuals, if they wish, can change if they suspect the behavior is a vice. The role of the environment comes to play in the sense the homosexuals gain acceptance by the parents and numbers. Moreover the religious faiths that represent a stronghold in many societies upheld homosexuality. Indeed, the support from the parents and the church accounts for a societys support. The aspects that the environment avails to human beings provide experiences for adoption in life (Schein Bernstein, 2008). These experiences shape the behavior of individuals. If the contextual society do not support expression of some behavior, the only possibility that such behaviour would sprout is if the behavior is genetically inherited or if the individuals displaying it are strong enough to accept the deviant labeling from the society. Conclusion In exploring the classification of factors that shape the behavior, many contemporary researches appreciate the role of both nature expressed in inherited genes as well as the nurture expressed as environmental experiences. Inherited mental characteristic need to be exercised and enhanced in the environment for it to be successfully propagated to the future generations. The culture which is the framework within which nurture takes effect definitely has a role to play in shaping up an individuals behavior. It is important for individuals to evaluate themselves and as independent entities compare their behavioral attributes to determine their compatibility with the environment. There may be instances when individuals display behaviour that is ideally unacceptable and hence such individuals would need to conform to the environment. In some other instances, individuals may need to explicitly explain their traits if they are ideally acceptable to fit them into the contextual environment. Either way, the influence of the environment display natural ways of eliminating expression of behaviour that is harmful in the environment. The genesis of homosexuality and indeed its acceptability remains both a nature and nurture contribution until other studies find it different (Boswell, 1981).

Childhood in Robert Frost's Birchess and William Blake's The Chimney Sweeper Robert Frost's view of childhood is much different than that of William Blake, as expressed in their respective poems, "Birches" and "The Chimney Sweeper". Living in the late seventeenth century, Blake saw some hard times; and as such, paints a very non-romantic picture of childhood. Frost, however, sees things differently. The result is two glaringly different poems that goes to prove how very different people are. Blake's portrayal of childhood is far from happy. A small child's mother dies while that child is still very young; this is sad but not all together strange. However the child's father then, very soon after, sells him off to be a chimney sweeper. Blake does not stop here; after a description these children's living conditions few emotions are left except for pity. As Americans living in the twenty first century, this all seams very strange. We see childhood as a time of joy, and innocence; a time to embrace, and to not let slip by too fast. We see childhood as Robert Frost does. Childhood, a time of adventure; a time when the world is large and mysterious, and there is always more explore; a time when there is no wrong that could not be righted by a mother's kiss. This is the childhood described by Robert Frost. He describes this through a portrayal of the child's game of riding birches; a careful climb, a well timed jump, and an exhilarating swing. Then he describes the loss when one ages. How one by one this boy subdues the trees until there are none left to swing from. Frost then finishes off by showing his longing to return to those days. How is it that two poems, written on the same theme, could be so incredibly d... ...about an ideal childhood, or that of a friend; and Blake could have done likewise. However, because they both wrote about the childhood they experienced, this validates our other theories on time and location. The difference between these two views of childhood are like night and day. One is a pleasant time, and the other is not. One is a time to hang on to, the other is a time to get passed. One is a time of joy, the other is one of hardship. Looking back on how my life has played out so far, I am glad that I should have the privilege of Frost's childhood, and not that of Blake; but one is by no means the norm and the other not. The primary factor causing the difference between Blake's and Frost's childhood was location, location in time and space. And, though as unfortunate as it may be, when the world is viewed in 4D Frost's childhood is hardly normal.

Ludwig Wittgenstein once believed that language's function was to name objects and the meaning of language was found in the objects for which it stands. He later rejected this and centred on how language works and is used, believing that problems of religious language come from misunderstanding its usage. Wittgenstein was no longer concerned with the truth or falsity of language but the way it is used and the functions that it performs, as he said 'Don't ask for the meaning ask for the use.' Wittgenstein recognised that language is equivocal as words have many different meanings, such as the word 'pen' whose meaning changes in different contexts. He saw language as a game, which like all games had its own set of rules. Different contexts or 'forms of life' are like different language games with their own self contained rules. Those not involved in a particular language game effectively become 'non-players' and so the language holds no meaning for them, however, this does not give the non-believer the right to dismiss religious language as meaningless. Wittgenstein used the example of 'soul' to illustrate the problems of trying to use words in the wrong language 'game'. He felt that the problems stemming from the word 'soul' are caused because people try to see it as a physical object. Such problems would disappear if people realised that the 'physical object game' didn't apply in this case. It was argued that language is a social product, therefore individuals could not have their own private language as one could not be certain that language was being used correctly. Wittgenstein therefore rejected Descartes ... ... Religious believers are also involved in other language games because they are involved in other aspects of life. This means that religious language is not totally isolated and there will be some common ground with other 'language games'. This may suggest that the non-believer may be able to understand religious language and decide if it holds any meaning for them. It is also argued that if anything, non-believers may be able to understand religious language better than a believer, as they can be more objective about it. It seems that Wittgenstein was mistaken as seeing religious language only being intelligible in the context of religious belief. Many religious statements entail a truth which is not dependent upon context, but statements such as 'Jesus died to bring salvation' are though of as true for everyone.
